After the Foreclosure Crisis What's Next?    Understanding the collection of deficiency judgments. Presented by Richard Evans, Esq. District Manager of Stewart Title.  What happens when the foreclosure crisis is over?  Former homeowners will need to clearly understand what can happen with regard to unresolved loan deficiencies resulting from a foreclosure, short sale or deed in lieu of foreclosure.  What you will learn in this class:

  1.  How a Loan Deficiency or deficiency judgment is created.
  2.  The time period in which a creditor can pursue a deficiency or judgment.
  3.  Property that is exempt from collection by a creditor inColorado.
  4.  The effect of Chapter 7 and Chapter 13 bankruptcy on a deficiency.
  5.  The process of levy, execution, garnishment and setoff.
  6.  How to avoid making a fraudulent or preferential transfer.

This course is approved for 2 Continuing Education credits.
